This research is entitled” Principle of Competitive Neutrality for State-Owned Enterprises to an Access Justice on Business Practices”. The background the problem in this dissertation that business competition conducted by (SOE’s) against private actors not neutral or fair, so it needs be based principle competitive neutrality. neutrality law companies must compete basis superiority their products and may take undue advantage. In case state has a role as regulator entrepreneur through SOE’s, difficult fulfill without being laws regulations. formulations are: 1) Constitutional state-owned enterprises national development; 2) Legal principles international legal instruments; 3) law. Based Article 1 paragraph (2) juncto 33 (1), (3) 1945 Constitution Republic Indonesia sovereignty hands people, production branches which are important affect livelihood people at large controlled used greatest prosperity most importantly economy structured joint effort kinship, SOE’s they can work together fairly with actors.
